Terms and Conditions - kaiwanTECH

1. Definitions

  • "Trainer": Typically refers to Kaiwan N Billimoria, the lead instructor for the training courses, operating under the name kaiwanTECH.
  • "Participant": The individual enrolling in and attending the training course.
  • "Course": Any training program offered by the Trainer(s) under kaiwanTECH.
  • "Training Materials": Any course content provided by the Trainer, including digital resources, presentations, source code, and exercises.
  • "Payment Processor": Refers to Razorpay, the service provider handling payment processing for the Courses.

2. Course Enrollment and Payment

Enrollment Process:

  • Participants must complete the registration form and submit the required payment before the course start date.
  • Registration is confirmed upon receipt of full payment unless otherwise agreed.

Residency-Based Options:

Indian Residents:

  • Only individuals who are Indian citizens residing in India may select the INR payment option.
  • AADHAR details must be provided at the time of registration to verify residency.

Foreign Citizens & Non-Resident Indians (NRIs):

  • Individuals who are not Indian residents or hold foreign citizenship must select the international payment option and pay in the relevant currency.
  • Passport details are mandatory to verify eligibility for this option.

Trainer’s Right to Cancel Non-Compliant Registrations: The Trainer retains the unilateral right to cancel any registration that violates the above residency-based payment requirements.

Payment Terms:

  • All course fees must be paid in full before the training begins.
  • Payments are processed securely through Razorpay, and Participants must adhere to Razorpay's terms and conditions when making payments.
  • Participants are responsible for ensuring successful payment completion, including any fees associated with currency exchange or international transfers.

Multi-Currency Payments & International Enrollments:

  • Participants outside India can make payments in other supported currencies.
  • Currency conversion rates may vary based on the payment processor’s exchange rates.
  • Any additional bank charges, foreign transaction fees, or currency conversion fees are the responsibility of the Participant.
  • International Participants must ensure compliance with their country’s tax and regulatory requirements regarding cross-border payments.

Discounts & Corporate Enrollments:

  • Discounts may be available for group enrolments or early registrations.
  • Corporate clients may request customized training sessions.

3. Cancellations and Refunds

3.1 Cancellation by the Participant

  • 30+ days before the course: Full refund.
  • 14–30 days before the course: 50% refund.
  • Less than 14 days before the course: No refund.

3.2 Cancellation by the Trainer

  • The Trainer reserves the right to cancel or reschedule a course due to unforeseen circumstances.
  • Participants will be offered a full refund or an alternative date.

3.3 Substitutions

  • Participant may nominate one substitute attendee at no additional cost.
  • The Trainer must be notified at least 10 business days before the course start date.

4. Course Completion and Discounts

Participants who attend at least 80% of all sessions and score an average of 65% or more in quizzes specified during the course will receive a Course Completion Certificate in PDF format, issued by Kaiwan N Billimoria, the lead instructor.

Enrolling in any course grants the participant a discount on the next course, provided the offer is availed within six months of the initial course registration date.

5. Course Attendance and Conduct

Prerequisites:

Participants are expected to check and verify in advance of course commencement, that they fulfill all required prerequisites for attending the Course. Attending the Course(s) without fulfilling all prerequisites implies that the Participant may not be in a position to understand all or part of the content coverage; thus, the fulfillment of all course prerequisites before course commencement is her/her sole responsibility and not that of the Trainer.

Attendance:

Participants are expected to attend all scheduled sessions. Failure to attend without prior notice may result in denial of certification.

Conduct:

Participants are expected to behave professionally and respectfully. The Trainer reserves the right to remove participants engaging in disruptive behavior. The training environment is committed to being inclusive, respectful, and welcoming to all Participants, regardless of background, gender, ethnicity, or experience level. Any form of discrimination or harassment will not be tolerated.

6. Intellectual Property

All Training Materials, unless stated otherwise, are copyrighted and licensed under the terms of the Creative Commons Attribution ShareAlike 4.0 International (CC BY-SA 4.0) license and remain, unless explicitly stated otherwise, the intellectual property of kaiwanTECH.

Participants are granted a limited, non-transferable license to use course materials for personal educational purposes only under the terms of the Creative Commons Attribution ShareAlike 4.0 International (CC BY-SA 4.0) license.

Reproduction, distribution, or commercial use of materials without written consent is strictly prohibited.

Recording

Participants are strictly prohibited from recording any part of the course sessions, whether by digital means (e.g., screen capture, audio/video recording apps) or physical means (e.g., note-taking via audio devices or filming the screen). Any violation will result in immediate removal from the course without refund and may invite further legal action.

Recordings, if and when provided during or after the session completion, will be only for registered participants and for a limited duration. The recordings must strictly not be shared or saved in any manner whatsoever, online or offline. 7. Confidentiality

Participants agree not to disclose proprietary information shared during the training. All code, exercises, and discussions remain confidential unless explicitly permitted by the Trainer.

8. Limitation of Liability

The Trainer is not responsible for any direct or indirect damages resulting from participation in the Course. Liability (to the extent relevant) is limited to the amount of the course fee paid by the Participant.

9. Data Protection & Privacy

The Trainer processes personal data in accordance with the Digital Personal Data Protection Act, 2023 applicable in India. The Trainer does not take responsibility for compliance with data protection standards applicable in jurisdictions, other than India, for international participants enrolling. By enrolling, Participants consent to the collection, processing, and storage of their data for training and administrative purposes.

Razorpay’s payment processing system may collect and store payment information under their privacy policies. Participants should review Razorpay’s privacy terms before proceeding with payments.

10. Payment Processing via Razorpay

All payments for training courses are processed via Razorpay. By making a payment, Participants agree to Razorpay’s Terms and Conditions, available at Razorpay’s official website. Participants should verify transaction details and ensure compliance with Razorpay’s refund and dispute resolution policies. kaiwanTECH is not liable for any technical issues, transaction failures, or payment disputes handled by Razorpay.

11. Governing Law & Dispute Resolution

These Terms and Conditions are governed by the laws of India. Any disputes shall be resolved through mediation first, failing which they shall be subject to the exclusive jurisdiction of the courts in Bengaluru, India.

12. Acknowledgment

By enrolling in any course, Participants agree to these Terms and Conditions and confirm they have read and understood the policies outlined above.
